Terms and Conditions of Trade

1. Definitions.

1.i

“The company” is Le Gallez & Co LTD and is the trading name of Le Gallez & Co referred to as “the company” 

1.ii

The company is a small photography company including drone, videography, 360 tours, energy performance certificates, floorplans, and legionnaires reports. The company shall determine its range of services.

1.iii

“The Trading Address” is 3 Mallock Road, Chelston, Torquay, TQ2 6AF.

1.iv

“The Correspondence Address is 3 Mallock Road, Chelston, Torquay, TQ2 6AF.

1.v

“The client” means any person, or persons, company, organisation, or other body to whom the company provides goods and services.

1.vi

“In writing” may be by means of conventional letter, facsimile, or electronic mail.

​2. Fees and charges.

2.i

When the fee is not discussed on instruction, the client agrees to pay the fee that will be charged in line with the company’s usual fees. These charges relate to usual working hours Monday through Friday. Please note that EPC charges apply even if the EPC is not lodged on the register.

2.ii

The company reserves the right to raise additional charges for attendance early mornings and late evenings, Saturdays, and Sundays. 

2.iii

Our minimum fee for a failed visit is £40+VAT.

2.iv   

The company also reserves the right to raise additional charges for any work completed that was not discussed in the original instruction.

3. Quotation and payment terms.

3.i

Quotations are valid for 30 days from the date of quotation.

3.ii

Any work required above that stated in the quotation document will be subject to additional charges.

3.iii

Unless otherwise stated in the quotation document the company assumes that all private and high valued possessions will be removed from the area in which the work is to be undertaken and cannot be held responsible for breakages where personal possessions have not been cleared away. Any additional work involved in removal of personal possessions, may incur additional charges.

3.iv

Payment may be made by cash, cheque, card online or bank transfer. Payment terms are 7 days from the date of the invoice unless another timescale has been agreed, in writing, prior to the commencement of the work.

3.v

The company reserves the right to charge interest at 8% over the Bank of England base rate on late payment of its invoices in line with the Late Payment of Commercial Debts (Interest) Act 1998 as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002 regardless of the size of the client.

Where a cheque is not honoured then the company reserves the right to charge interest as above, plus any charges incurred from its bankers and charge a handling fee of £25+VAT.

3.vi

“Retention of Title”. All marketing materials supplied remain the property of the company until payment is made in full. The company reserves the right to reclaim such materials if payment is not received within a reasonable time. “Reasonable time” shall be defined by the company.

​4. Cancellations.

4.i

Should a client need to cancel or re-arrange an agreed meeting/work time slot with less than 48 hours’ notice, the company reserves the right to recover any incurred costs or loss of income.

4.ii

The company endeavours to honour agreed meeting times or work slots arranged, but clients must be aware that traffic, weather, and other events outside the company’s control may force a change in arrangements.

​5. Complaints.

5.i

Any complaint should be made in writing to the company at the correspondence address. The company will endeavour to respond to any complaint within 14 days.

​6. Statutory rights and governing law.

6.i

These terms and conditions do not prejudice or nullify the statutory rights of the client or the supplier in any consumer transaction as to the quality and fitness to any particular purpose of any goods, materials or services supplied and shall be of no effect in such a transaction if inconsistent with these terms.

6.ii

These terms and conditions shall be exclusively governed and construed in accordance with the laws of England and Wales and each of the parties hereto submit to the exclusive jurisdiction of the English courts.

​7. In general.

 7.i Any photos that have been taken by Le Gallez and Co will only be stored in archives for 6  months due to the sheer volume of photos that are being taken daily. The Client is responsible for ensuring that they have downloaded and saved to their own devices the photos that have been sent from the photoshoot. Any issues with receiving these images must be reported to us within 3 working days of the appointment. 

7.ii

When clients entrust our company and/or its associates with the keys to their premises for the duration of the service, we commit to taking all reasonable measures to secure the premises. However, we cannot be held liable for any loss of keys or breaches of security at the premises.

7.iii

These conditions shall prevail unless expressly varied in writing and signed by the company.

7.iv

The company reserves the right to change these conditions from time to time. Where the conditions are changed during the period of the contract, then the terms shall be no less fair.

8. Revisit Terms

Le Gallez & Co Ltd strive to capture the essence of your property through our photography services. Our goal is to complete all necessary photography in one visit, ensuring efficiency and minimizing inconvenience. However, we understand that certain circumstances may require a revisit to the property. These Terms outlines our policies regarding such revisits, including when they are necessary and the associated fees.

**Revisit Policy**

8.i 

**Initial Visit Expectations**: During our initial visit, we aim to capture the property comprehensively. We encourage our clients to prepare the property beforehand, considering furniture placement, decoration, and any other elements critical to the photography session.

8.ii 

**Circumstances Leading to Revisits**:
   **Furniture Adjustments**: If a revisit is requested due to the need for significant furniture adjustments or staging changes that were not completed prior to the initial visit, a revisit fee will be applicable.


   **Weather Conditions**: We schedule photography sessions based on forecasted weather conditions to ensure optimal lighting and ambiance. Should adverse weather conditions unexpectedly compromise the quality of the photos, we may reschedule the session at no extra charge. However, if a revisit is requested due to a preference for different weather conditions after the session has occurred, an additional fee will be charged.


   **Tide Conditions**: For properties where tide levels significantly impact the photographic representation, we will plan the initial visit accordingly. Should a revisit be requested to capture the property at a different tide level, this will incur a revisit fee.

8.iii 

**Revisit Fees**:
   - The revisit fee will be determined based on the nature of the revisit, the duration, and any additional resources required. This fee covers the photographer's time, travel expenses, and any additional post-processing required.
   - A detailed quote will be provided for the revisit fee based on the specific circumstances necessitating the revisit.

8.iv 

**Scheduling Revisits**:
   - Revisits must be requested within 5 working days following the initial photography session.
   - The scheduling of revisits is subject to availability and may be influenced by existing bookings and weather conditions.

8.v 

**Payment of Revisit Fees**:
   - Revisit fees must be agreed and requested in writing in advance of the scheduled revisit date.
   - Payment terms will be outlined in the revisit fee. A quotation can be provided to the client if requested.

**General Terms**:
   - Le Gallez & Co Ltd reserves the right to modify these terms and conditions at any time without prior notice.
   - By requesting a revisit, the client agrees to these terms and conditions.
